The Additional District and Sessions Judge-2 has rejected the first regular bail application of Gurmeet Singh, accused under the NDPS Act. The plea was filed under Section 483 of the Code of Criminal Procedure.
The advocate representing Gurmeet Singh argued that he was falsely implicated, has been in custody for a long time, and that no recoveries had been made from him. The lawyer requested bail, citing the lengthy trial process.
However, the government counsel opposed the plea, stating that a significant quantity of heroin, classified as commercial, was recovered from the accused. The counsel added that Gurmeet Singh is linked with other co-accused and could influence the investigation or intimidate witnesses if granted bail.
After hearing both sides and reviewing police records, the court observed that commercial quantities of heroin were indeed recovered from Gurmeet Singh. The court noted that his role in the case is serious and granting bail could affect the investigation. Consequently, the court found no sufficient grounds to release him on bail.
Case details
Gurmeet Singh, 37, a resident of Behlaiwal village, Sadik police station, Faridkot district, was arrested on July 17, 2024, by STF Mohali under FIR No. 105. He faces charges under sections 21C, 27, and 29 of the NDPS Act.
Police said Gurmeet Singh, along with co-accused Navdeep Kaur, alias Nav, was travelling in a Volkswagen Polo when 440 grams of heroin were recovered during a search. During interrogation, Navdeep Kaur said that she had purchased 500 grams of heroin from accused Gagandeep Singh, alias Gagan. Out of this, she sold 30 grams to accused Lovepreet Singh, alias Lovely, who arrived with accused Gulshan Kaur in a Scorpio. Based on Navdeep’s statement, the police seized 1.5 kilograms of heroin from Gagandeep Singh and named other accused in the case.
