The Allahabad High Court has observed that the concept of live-in-relationship is “against the settled law in the Indian middle-class society”.
Granting bail on Tuesday to a man accused of rape on the false promise of marriage, the single-judge bench of Justice Siddharth also expressed concern over the rising number of such cases. The bench was hearing the bail application of the man who has been in jail since February this year.
“After hearing the rival contention, this court finds that after live-in-relationship has been legalized by the Apex Court, the Court had fed up such cases. These cases are coming to the Court because the concept of live-in-relationship is against the settled law in the Indian Middle Class Society,” Justice Siddharth observed.
The complainant’s counsel submitted that the man had committed the offence which would ruin her entire life since no one would be willing to marry her.
“These cases are coming to the Court because the concept of live-in-relationship is against the settled law in the Indian Middle Class Society. The concept of live- in- relationship goes against the interest of the women since a man can marry even after live-in-relationship a woman or number of women but it is difficult for the women to find a life partner after a breakup. The concept of live-in-relationship has attracted the young generation allot but its aftereffects are seeing in the case like the present case,” the court said.
A case was registered against the man in Kanpur earlier this year under different sections of the Bharatiya Nyaya Sanhita (BNS) and the Protection of Children Sexual Offence (POCSO) Act. He was accused of f raping the prosecutrix on the false promise of marriage.
It was alleged that the complainant had accompanied him to several places, after which he refused to marry her.
